Housebreaking offender’s appeal dismissed

THE Court of Appeal recently dismissed the application of a housebreaking offender to have his sentence of 30 months’ imprisonment and two whippings reduced.

Justices John Barry Mortimer, Leonard and Burrell decided that the Intermediate Court had rightly treated Harisan bin Haji Raub as a first offender, even though he had two minor previous convictions over 10 years ago.

Harisan had denied the housebreaking charge and was convicted after a trial resulting in the sentence.

The Court of Appeal Justices found that the Intermediate Court judge’s sentence “was a fair and lenient one at the lower end of the acceptable range of sentences for the serious criminal activity.”

However, the Court of Appeal urged courts to make greater efforts on listing cases and adjournments so that the trials can be disposed of in one continuous hearing.

“Hearing a trial on 10 separate days spread over a 17-month period is not satisfactory,” the Justices said, seeing that the housebreaking trial was conducted in such a span of time.
