THE Employees Trust Fund (TAP) recently conducted a joint inspection visit with the Local Employment and Workforce Development Agency (APTK) to business premises in Brunei-Muara District.
The main purpose of this visit is to ensure that employers have undertaken the responsibility to register their local workers and make contributions to the TAP and Supplemental Contributory Pension (SCP) Scheme as well as ensuring that employers comply with the Employment Order 2009 particularly on the rights and welfare of local workers.
From the inspection, it was found that there were employers that failed to provide proper employment contracts to their workers and were not paying overtime salary to those working more than eight hours a day.
These employers have been instructed to be present at TAP office for further actions, such as, processing the registration of their employees and to make payment of contribution and arrears, if any.
The APTK would like to remind all employers on the necessity to provide a proper employment contract, in accordance to the Employment Order 2009.
If found guilty, employers will be fined or sentenced to an imprisonment for not more than one year, or both.
According to the Employment Order 2009, an employee is permitted to work up to a limit of 72 hours of overtime in a month.
However, the limit may be exceeded if approval has been granted by the Commissioner of Labour.
Any employer who fails to pay the overtime of an employee will be liable on conviction to a fine not exceeding $3,000, or imprisonment for a term not exceeding one year or both.
TAP would also like to take this opportunity to inform the public that it is mandatory for employees who are citizens and permanent residents of this country to be registered to TAP and contributions are paid to the TAP Scheme and SCP Scheme every month. This includes temporary workers, contract workers, daily paid workers and workers on probation.
Under Section 26 of TAP Act, if found guilty an employer will be fined not more than $3,000 for the first offence and not more than $10,000 for second and subsequent offences.
